Some Tips to Choose a Divorce Lawyer

Gregory John Norman, the Australian golfer and entrepreneur has divorced his famous tennis player wife Chris Ever after a married life of mere 18 months. Unlike many other celebrity breakups, these couples have had a quiet and hush-hush divorce. Many couples who are planning to apply for an Alberta divorce may also prefer a quiet and quick divorce rather than making it the most unpleasant experience in their lives.

However, divorce is not a single process. It involves many issues and problems that you may find difficult to deal without a professional support. A simple mistake while filing the divorce petition or responding to it can cause you costly losses.

A divorce lawyer supports you to handle complicated divorce issues like child custody and support, visitation rights, spousal alimony, and division of marital property. An attorney can protect your rights and interests during divorce procedures. However, make sure to choose a right divorce lawyer.

The main criticism against hiring divorce lawyers is that they are very expensive. Find a lawyer who is efficient, and at the same time affordable for you. It is wise to select a lawyer who has some experience in dealing with divorces cases. The lawyer should have a sound knowledge of your state’s family laws.

How to file for divorce when someone other than parents has custody of children?
I have a friend whom is wanting to do a do-it-yourself divorce. Him and the ex have two boys ages 8 and 9. The maternal grandmother has full legal custody of the boys and lives in Nebraska. Divorce will be in Kentucky. The grandmother left KY and moved to Nebraska. My friend already pays child support to the maternal grandmother. So his question is since neither parent has any rights to the children do the children still need to be listed in the divorce? Thanks.

When I filed the papers ask if someone else had custody of the kids. There is a box to check for that, but this is in Alaska. So, just go to the courthouse and get the papers and see what they say.

Hire a lawyer who can understand that you are going through the most painful situation in your life. You may have a negative attitude and suffer from mood swings and irritability. Emotional stress can affect your ability to take appropriate decisions while negotiating with your spouse. Your lawyer should be able to help you to think sensibly and to take rational decisions while dealing with sensitive issues like child custody and care.http://www.divorcecourt.com/

Try to choose a divorce lawyer with whom you can feel free to express your doubts and worries about the divorce. You should try to establish a good communication with the lawyer. Always be honest and never hide any important facts or document from your lawyer. An attorney cannot give you appropriate legal advices if the information you supplied are faulty and incorrect.

If possible, do your own research to find out the best lawyers in your area. There are many websites that give information about Alberta divorce lawyers. Couples who want to hire a lawyer can visit these sites. You can also seek opinions from friends and relatives before selecting your divorce lawyer.

Myths about Annulment of Marriage

I recently read an article about annulment of marriage. The writer explains in detail the grounds for annulment. This article is very helpful in clearing many doubts about annulment or nullification of marriage. I think, many people are confused about the differences between divorce and annulment. Actually, many spouses who are going to get a divorce in Alberta can try for an annulment of their marriage instead of a divorce.

Annulment of marriage is a legal procedure by which an invalid marriage is declared as void or null. It should be noted that annulment is entirely different from divorce. Annulment is not applicable to valid marriages. Divorce is required to terminate legal marriages. However, divorce can only put an end to the marriage. At the same time, an annulment makes a marriage null and void, as if it never happened. Couples can seek for annulment of marriage only if their marriage is considered as invalid by law.

A marriage is invalid if either of the wedding couples is below the minimum age of marriage. In Alberta, the marriageable age is 18. However, if you are 16 or 17 years of age, you can get married with the written consent of your parents or legal guardian. Boys under the age of 16 cannot get married under any circumstances. Anyway, it is possible for a girl below the age of 16 to get married if she is pregnant or is the mother of a living child.

Marriage annulment can be obtained for bigamous marriages. Bigamy or having more than one spouse is illegal in most societies.

How long does an amicable divorce take to finalize in the state of Oregon?
Hi Everyone,

If one were to file for an amicable divorce in the state of Oregon, how long does it take for the divorce to finalize? Also, would one have to file for separation before filing for divorce in Oregon? Anything helps!

Thanks!

An amicable (or uncontested) divorce is much faster than a contested. However the state of Oregon has a 90day mandatory waiting period. What this means is after all the paperwork is done and filed you need to wait 90 days after the day of filing before you will become legally divorced.

Alberta divorce law also does not recognize incestuous marriages like marriage between close relatives. Marriage can be annulled if one of the spouses has not been mentally stable at the time of marriage. Impotence or the inability of one party to consummate the marriage is a sufficient ground for seeking annulment.

You can file for annulment of marriage if your spouse has a history of criminal behavior or sexually transmitted diseases. Annulment is also obtainable if one of the spouses entered into marriage due to force, threat, or pressure from the other spouse or from a third party.http://www.lds.org/ldsorg/v/index.jsp?hideNav=1&locale=0&sourceId=ec21b5658af22110VgnVCM100000176f620a____&vgnextoid=2354fccf2b7db010VgnVCM1000004d82620aRCRD

I think couples should discuss with their lawyers before applying for a divorce in Alberta.  If there is any chance, they can apply for annulment of their marriage.

However, as the writer of article points out, annulment is not an easy process. Its proceedings are somewhat similar to that of a divorce.
